By registering for, accessing, or using the WXOPS service ("Service"), you ("User", "Customer", "Organisation") agree to be bound by these Terms of Service ("Terms"). If you are accepting these Terms on behalf of an organisation, you represent that you have the authority to bind that organisation.
If you do not agree to these Terms, you must not use the Service. These Terms constitute a legally binding agreement between you and WXOPS.
You must be at least 18 years of age to use this Service. By using the Service, you represent that you are at least 18 years old.
WXOPS is a web-based aviation weather monitoring and situational awareness platform that provides:
The Service is provided on an "as is" basis. Weather data is sourced from third-party APIs and is subject to their availability, accuracy, and timeliness. WXOPS does not generate original meteorological data.
WXOPS IS NOT A CERTIFIED AERONAUTICAL SERVICE.
This section is critically important. By using WXOPS, you explicitly acknowledge and agree to the following:
If your organisation's procedures require the use of specific certified meteorological services, WXOPS does not replace those requirements.
To use WXOPS, you must register an account and provide accurate, complete, and current information. You are responsible for:
Each organisation may maintain one active subscription. Creating multiple accounts to circumvent plan limits is prohibited and may result in immediate termination of all related accounts.
We reserve the right to refuse registration, suspend, or terminate any account at our sole discretion, particularly where we reasonably suspect violation of these Terms or applicable law.
Plans and pricing: WXOPS offers Starter (€49/month), Professional (€149/month), and Enterprise (€349/month) subscription plans, billed monthly. Prices are exclusive of VAT. Applicable VAT will be added at checkout based on your billing location.
Payment processing: All payments are processed by Stripe, Inc. By subscribing, you authorise WXOPS to charge your payment method on a recurring monthly basis. You must provide valid payment information and keep it current.
Billing cycle: Subscriptions renew automatically on the same day each month. You will be charged at the start of each billing cycle.
No refunds: All subscription fees are non-refundable except as required by applicable consumer protection law or where WXOPS has materially failed to deliver the contracted service. Partial month refunds are not provided upon cancellation.
Plan changes: Upgrades take effect immediately. Downgrades take effect at the next billing cycle. If you exceed your plan limits (e.g. number of airports), you will be prompted to upgrade.
Late payment: If payment fails, we will retry the charge and notify you. Access may be suspended after 7 days of failed payment. Accounts suspended for non-payment will be terminated after 30 days.
New accounts are granted a 14-day free trial with access equivalent to the selected plan. No credit card is required during the trial period.
At the end of the trial period, your account will be suspended unless you provide payment details and activate a subscription. Trial data (airports, alerts, fleet configurations) will be retained for 30 days after trial expiry.
Each organisation is entitled to one free trial. Creating multiple organisations to obtain additional trial periods is prohibited.
You agree not to use the Service to:
Violation of acceptable use may result in immediate account termination without refund.
WXOPS and its underlying software, design, algorithms, and documentation are the intellectual property of WXOPS and are protected by copyright, trade secret, and other applicable laws. These Terms do not transfer any intellectual property rights to you.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your internal business purposes during the term of your subscription.
Weather data displayed by the Service is sourced from publicly available government sources (NOAA, FAA) and is not proprietary to WXOPS.
You retain ownership of all data you upload or create within the Service, including airport configurations, alert rules, and fleet data ("Customer Data").
By using the Service, you grant WXOPS a limited licence to process and store your Customer Data solely for the purpose of delivering the Service to you.
WXOPS will not access your Customer Data except to provide the Service, respond to support requests, or as required by law. We will not use your Customer Data for any other purpose, including product development or research, without your explicit consent.
You are responsible for the accuracy of data you input, including aircraft performance limits. WXOPS is not responsible for incorrect Go/No-Go assessments resulting from incorrectly configured limits.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
Some jurisdictions do not allow certain limitations of liability. In such jurisdictions, liability is limited to the minimum extent permitted by law.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WXOPS DOES NOT WARRANT THAT:
We aim to maintain 99% uptime but do not guarantee it. Planned maintenance will be communicated in advance where possible.
You agree to indemnify, defend, and hold harmless WXOPS and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
By you: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access until the end of the paid period.
By WXOPS: We may suspend or terminate your account immediately and without notice if you violate these Terms, engage in fraudulent activity, or if required by law. We may also terminate accounts with 30 days' notice for any other reason.
Effect of termination: Upon termination, your right to access the Service ceases immediately. Your Customer Data will be retained for 30 days and then permanently deleted, unless you request earlier deletion or retention is required by law.
These Terms are governed by the laws of Hungary and, where applicable, the laws of the European Union. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Hungary, unless mandatory consumer protection law in your jurisdiction requires otherwise.
Before initiating legal proceedings, we encourage you to contact us at legal@wxops.io to resolve disputes amicably. We are committed to resolving issues fairly and promptly.
If you are a consumer in the EU, you may also use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
We may update these Terms at any time. For material changes, we will provide at least 30 days' notice by email before the new Terms take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you may cancel your subscription before the effective date and receive a prorated refund for the unused portion of your current billing period.
